When US Economic Sanction Meets AI/ML
Given the ambiguity surrounding national security within federal affairs, this paper seeks to alleviate the uncertainty stemming from AI/ML applications in the realm of national security through the case of economic sanction enforcement. Observing the evolving approaches of various US administrations reflects the dynamic nature of US approaches, which provides the political foundation for AI/ML applications in the context of national security. Considering economic sanction’s role in trade and financial restriction, it specifically examines how AI/ML improves export control policy by Bureau of Industry and Security and financial sanctions by Office of Foreign Assets Control with an emphasis on licensing and illicit tracking areas. While licensing can be improved with nimbleness and accuracy by operating intelligence function, tracking illicit activities can get benefits from inference function through patterns deducted by fraudulent transactions. However, it is important to address four crucial considerations: a) the involvement of human officials as reviewers, b) the construction of explainable model, c) the potential vulnerability to adversarial attacks and d) the occurrence of false negative cases. This paper, while sheds light on the limitations of AI/ML application in economic sanctions, underscores the pivotal role played by human officials, the imperative of recruiting highly qualified personnel, and the necessity of striking a delicate balance between efficiency and safety.
